The Supreme Court overturns judge’s decision that fuel producers cannot challenge the EPA under California regulations

The U.S. Supreme Court ruled that fuel producers are in a position to challenge the Environmental Protection Agency’s moves. California Implements regulations on car manufacturers regarding vehicle emissions and electric vehicles.

“In light of this court’s precedent and the evidence before the Court of Appeal, the fuel producer has established a third generation III that exists to challenge the approval of the California rules of EPA. It overturns the Court of Appeal and remands the case of further suits that concur.”
Explaining California’s regulations, the majority opinion filed by Trump-appointed Judge Brett Kavanaugh said, “Regulations generally require carmakers to limit average greenhouse gas emissions across the fleet of new vehicles sold in the state, and require that a certain percentage of electric vehicles be manufactured as part of the vehicle fleet.”
The EPA will launch or reassign hundreds of people to tackle “environmental justice.”

“To date, acting under the Clean Air Act, 17 states and the District of Columbia have copied California greenhouse gas emission standards, mandate new cars, electric vehicles, or both,” the opinion states.

“It may not be certain here, but it’s at least “predictable” that by overturning California regulations, fuel producers are likely to end up selling more gasoline and other liquid fuels,” the opinion said.
