Legal experts analyze Diddy’s defense strategy in sex crime cases

Chutkow pointed out how the burden of proof lies with the government, not the founder of Bad Boy Records or his team.
“When you present a case, if you’re on the defense side, you’re better off because if it’s flattened, you might go back to some sort of marker and you might be in a worse position,” the lawyer said. “So, it’s often less sometimes. In a way, defense might be the opportunity to say, ‘No, we didn’t have to do it.’ ”

With the lawsuit approaching more than seven weeks after the start of the lawsuit, and nine months after Diddy was arrested and charged, Chatkow thought both sides had done “what they were trying to achieve.”
“The prosecutor put all the evidence in. That’s not ruled out. But defense did an amazing job in cross-examination,” he said. “They bring a lot of additional communication between Didi and these other women, indicating that the relationship is more complicated.
“One of the things that prosecutors think they have to do in their final argument is basically, “Look, this isn’t like the case of human trafficking seen on TV. That’s not the case, there’s no situation where someone is being lured and taken away from their chains by an underground radiator. Essentially, it’s a golden cage.”
