Allegations of racial bias in relation to the Education Sector Probe Dew Closure

Ministry of Education On Monday, it announced it would begin an investigation into Duke University and the Duke Law Journal about alleged racial bias in selecting a new editor.
The Department of Education’s Civil Rights Office (OCR) reported that Law Journal distributed packets to schools’ “affinity groups” in 2024 regarding the application process to join the journal in the New Year. Each applicant was asked to write a 12-page note analysing the appeal court decision and the 500-word personal statements to be reviewed in a point-based grading system along with the first-year GPA.
However, applicants for these “affinity groups” were reportedly given the opportunity to receive extra points if their statements referenced “racial or ethnicity” and to describe how “underrepresented group membership” promoted “diverse voices.”

The OCR believes that this action could be a potential violation of Title VI of the 1964 Civil Rights Act.
“If Duke illegally gives priority treatment to law journals or medical school applicants based on the immutable characteristics of these students, it is a humiliation not only for civil rights law but also for the feasible character of academic excellence,” Linda McMahon said. In a statement. “The constitution, anti-discrimination laws, and blatant discriminatory practices that are illegal under the Supreme Court precedents have become too common in our educational institutions. The Trump administration will not allow them to continue.”
McMahon, along with Robert F. Kennedy Jr. of the Department of Health and Human Services, told the school “Review all policies and practices at Duke Health for the illegal use of race preferences, and to reform all people who have obligations to benefit from, review all policies and practices at Duke Health for illegal use, and to reform all people who have obligations to benefit from, and to provide a clear way to provide for loyalty and to provide a clear opportunity to benefit from public benefits. By making all organizations, leadership and personnel changes, we will be more likely to receive public benefits, and to ensure that all necessary reforms are durable.”
The department also calls for Duke University to establish a “Meiha and Civil Rights Commission” to help resolve civil rights violations.
