Australia implements essential food and grocery codes for supermarkets


Australia’s leading supermarkets and grocery wholesalers will be subject to the mandatory code of food and grocery conduct from April 1, 2025.

The Australian Competition and Consumer Commission (ACCC) has declared the enforcement of the revised code.

The code, enacted under the Competition and Consumer Act, applies to retailers and wholesalers over $5 billion ($3.133 billion) from supermarket or grocery wholesale operations in the previous year.

This code automatically extends the protection of suppliers that handle these entities. We provide an overview of the steps for how supermarkets and wholesalers engage in negotiations and establish contracts with suppliers.

It requires the creation of written supply agreements, compliance with legal actions, and the obligation to treat suppliers in good faith. We also protect our suppliers from any form of retaliation if we choose to assert our rights under the Code.

The ACCC is granted new authority to enforce compliance with the Food and Food Code of Conduct. You can issue an infringement notice and start legal proceedings against businesses that violate the code.

For severe violations, penalties can escalate to $10 million per case, or three times the profits earned from the violation.

These enhanced penalties serve as important deterrents to complying with code regulations.
