Ice begins nationwide arrests of illegal immigrants after asylum hearing

Immigration Customs Enforcement (ICE) officials are launching a national initiative to arrest illegal immigrants after an asylum hearing leaving the court.

The effort will target people living in the US within two years, sources said.

The Department of Homeland Security (DHS) strategy aims to remove illegal immigration cases. Federal officials will arrest immigrants, place them in a swift removal procedure, quickly track them down for deportation abroad, and allow them to be removed almost at first glance without hearing in front of an immigration judge.

If an immigrant file an aggressive, pending court case, no prompt removal will occur. So DHS officials plan to remove them. However, immigration judges must agree to drop the case, and so far they have cooperated in the effort, sources said.

The initiative will likely be controversial as immigrants block attendance at asylum hearings.

The video, posted on social media and captured by local news nationwide, shows the arrests of ice already happening in various courts.

“Secretary Gnome is reversing Biden’s catch-and-release policy that allows millions of illegal aliens to be unleashed on American streets,” a DHS spokesman told Fox News. “This administration is once again enforcing the rule of law.”

The spokesman added: “Most aliens that have illegally entered the US within the past two years will be subject to rapid removal.”

“Currently, ICE is in line with the law to promote the rapid removal of these illegal aliens.

“Biden ignored this legal fact and chose to release millions of illegal aliens, including violent offenders, to the state with notice of appearance before an immigration judge,” the spokesman said. “Currently, ICE is following the law to ensure that these illegal aliens are removed quickly, as they are always.

Gregg Jarrett, a legal analyst and commentator for Fox News, said in a recent Supreme Court decision that he “is power to end Biden’s temporary protection status (TPS) against certain designated immigrants who have been in the United States for less than two years.”

“That means they are eligible for a quick deportation,” he said. “There is no law that prevents ice from implementing the initiative by arresting at immigration/asylum hearing. From a safety standpoint, that makes sense. In fact, it has been a practice for many years.”

Kate Lincoln Goldfinch, immigration lawyer and CEO and owner of Lincoln Goldfinch Law, told Fox News Digital: “ICE can come in and file concerns in court, but “such arrests” could be restricted if an immigration judge refuses the case.”

“This is the playbook. Immigrants go to court hearings. The DHS lawyer, essentially a prosecutor, tells the judge, “Judge, we actually want to dismiss this case. We don’t want to pursue it.” And in many cases, judges either deny objections to immigration, or if (if they do) the immigrants don’t know much more, they say, “It certainly sounds great.” And they’ve come out of court and they’ve been arrested,” Lincoln Goldfinch explained.

If a judge refuses to dismiss the case, “you can maintain your jurisdiction over what happens in the immigration (immigrant) because this person is in an immigration court case, and the judge decides what happens to them unless they dismiss the case.”

When asked if the judge might try to stop the arrest, Jarrett believes “the possibility of interference is minimal.”

“Most asylum and deportation hearings are in front of immigration judges, who are employees of the Department of Justice,” he said. “These hearings occur in federal courts or detention facilities, so the chances of interference are minimal. For example, there is no state court judge trying to interfere, as we saw in (Milwaukee, Wisconsin).”

Meanwhile, Lincoln Goldfinch believes the new DHS effort is a plan for the Trump administration to increase the number of illegal immigrant arrests easily and quickly, saying, “They are not targeting the immigrant population that Trump and Christy Noem want to oust, and that’s the type of law-breaking, dangerous history-type immigrants.”

The initiative targets illegal immigrants who are trying to go through the legal citizenship process, she said.

After those who claim they are here to do harm to us, why don’t we send ice? That makes no sense from a resource expenditure perspective,” she said. “And I think that’s the main objection. So, do you think this will be challenged in court? But on top of that, I think people should really be problematic with the fact that Ice is chasing people who follow the rules.

In a press release on April 29, DHS announced that border concerns have fallen by 95% since the president, with the 100-day inauguration. Donald Trump Now in office, more migrants are returning to their home countries to avoid deportation.

The administration also said it arrested more than 158,000 illegal aliens in 2025 alone. This included more than 600 Tren de Aragua members who said federal officials were “targeting the worst and worst.”
