The court overturned the previous decision, saying, “This claim is another matter that can be pursued independently of other claims in complaints addressing the consumer transaction in question. As this claim does not fall within the scope of the arbitration agreement, this claim should not be dismissed and sent to arbitration.”
The case has returned to the lower court for additional legal proceedings.
